These Terms of Service apply to purchases made from Alan Pick trading as Nature Noticed, a sole trader based in Wales, United Kingdom.

By placing an order through Nature Noticed, you agree to these terms. Nothing in these terms excludes or limits any statutory consumer rights that cannot lawfully be excluded or limited.

1. About Nature Noticed

Nature Noticed sells products featuring original photography and other photographic artwork.

Physical products may be produced, printed, packed and shipped to customers by third-party print-on-demand and fulfilment providers acting on behalf of Nature Noticed.

Shopify hosts the online store and provides ecommerce technology. Shopify is not the seller of products offered by Nature Noticed.

2. Products

We take reasonable care to ensure that product descriptions, photographs, specifications and prices are accurate.

Because products are manufactured or printed to order, minor variations in colour, print positioning, finish or appearance may occur between the on-screen representation and the finished product.

Screen settings can also affect how colours appear.

These reasonable variations do not affect your statutory rights if goods are faulty, damaged, not as described or otherwise fail to conform to the contract.

Where a product is advertised as a limited edition or fixed production run, the edition size stated on that product page applies to that specific product design.

3. Orders and contract formation

Product listings on the website are invitations for customers to place an order.

When you submit an order, you are making an offer to purchase the selected products.

A contract is formed when Nature Noticed accepts your order.

We may refuse or cancel an order before acceptance where, for example:

• A product is unavailable.

• Payment cannot be authorised.

• Pricing or product information contains a material error.

• We are unable to deliver to the supplied address.

• We reasonably suspect fraudulent or unauthorised activity.

If payment has already been taken for an order that we cannot accept, the relevant payment will be refunded.

4. Prices and payment

Prices are displayed in the currency shown on the website or at checkout.

Any applicable delivery charges, taxes and other charges collected by Nature Noticed will be displayed before you place your order.

Payment must be made using one of the payment methods offered at checkout.

For international orders, customs duties, import taxes or other charges may apply depending on the destination.

Where these charges are not collected at checkout, the customer may be responsible for paying them where permitted by applicable law.

5. Delivery

Nature Noticed delivers within the United Kingdom and to selected international destinations where a delivery option is available at checkout.

Availability varies according to the product, fulfilment provider and destination.

If no delivery option is offered for a particular product and address at checkout, that product is not currently available for delivery to that destination.

Estimated delivery times may be displayed at checkout or provided after purchase.

Delivery estimates are not guaranteed unless we expressly agree a fixed delivery date.

Delivery may be affected by carrier delays, customs processing, severe weather, busy periods or circumstances outside our reasonable control.

6. Delivery address

You are responsible for providing a complete and accurate delivery address.

If you discover an error after placing your order, contact us as soon as possible at noticingnature00@gmail.com.

We cannot guarantee that an address can be changed after fulfilment or production has begun.

7. Risk and ownership

For consumer purchases, risk in the goods passes to you when the goods are delivered to you or to another person nominated by you to receive them.

Ownership of the goods passes when we have received payment in full.

8. Cancellation and withdrawal rights

UK, EU and EEA consumers buying online generally have a statutory right to withdraw from eligible purchases within 14 days after receiving the goods, subject to applicable legal exceptions.

For orders delivered in separate lots or pieces, the withdrawal period may begin when the final lot or piece is received.

You may notify us of withdrawal by using an available return or cancellation facility or by emailing:

Your message should clearly state that you wish to withdraw from the contract and should include your name and order number where possible.

9. Exceptions to withdrawal rights

The statutory right to withdraw may not apply to certain products, including goods that are:

• Made to the customer's specifications.

• Clearly personalised.

• Liable to deteriorate or expire rapidly.

• Sealed for health protection or hygiene reasons and unsealed after delivery.

• Otherwise excluded from withdrawal rights by applicable law.

The fact that an ordinary product is manufactured or printed after an order is placed does not by itself remove statutory consumer rights.

10. Returns and refunds

Returns and refunds are handled in accordance with our Refund Policy and applicable consumer law.

For an eligible withdrawal, refunds will be processed within the periods required by applicable law.

Where applicable, the refund will include the cost of the least expensive standard delivery option offered for the original order.

Refunds will normally be made using the original payment method unless otherwise agreed.

11. Faulty, damaged or non-conforming goods

If goods are faulty, damaged, not as described or not fit for purpose, your statutory rights apply.

Depending on the applicable law and circumstances, remedies may include:

• Repair.

• Replacement.

• Price reduction.

• Refund.

UK consumers retain all rights available under UK consumer law.

EU and EEA consumers retain applicable statutory conformity rights and legal guarantees in their country of residence.

12. Intellectual property

Unless otherwise stated, original photography, artwork, written content and other original material displayed by Nature Noticed are owned by or licensed to Alan Pick trading as Nature Noticed.

Purchasing a physical product does not transfer copyright or other intellectual-property rights in the underlying photograph, artwork or design.

Content may not be reproduced, copied, commercially exploited, distributed or used to create derivative products without permission except where permitted by law.

Third-party trademarks, service marks and other intellectual property remain the property of their respective owners.

13. Website use

You must not misuse the website, attempt unauthorised access, introduce malicious software, interfere with website operation or use the store for fraudulent or unlawful purposes.

We may restrict access, refuse transactions or take other reasonable measures where we reasonably believe the website or ordering system is being abused.

14. Liability

Nothing in these terms excludes or limits liability where doing so would be unlawful.

This includes liability for:

• Death or personal injury caused by negligence.

• Fraud or fraudulent misrepresentation.

• Breach of mandatory statutory consumer rights.

Subject to those rights, Nature Noticed is not responsible for losses that were not reasonably foreseeable when the contract was formed or for business losses suffered by someone purchasing as a consumer.

15. Personal information

Personal information is handled in accordance with the Nature Noticed Privacy Policy and applicable data-protection law.

Shopify and relevant service providers may process information where necessary to operate the store, process payments, fulfil orders and arrange delivery.

16. Third-party fulfilment providers

Nature Noticed may use third-party companies to manufacture, print, package and deliver products.

These providers perform fulfilment services on behalf of Nature Noticed.

The use of a third-party fulfilment provider does not remove or reduce the consumer rights you have against Nature Noticed as the seller.

17. Governing law and disputes

These terms are governed by the laws of England and Wales.

However, consumers retain any mandatory protections available under the laws of the country in which they habitually reside.

Nothing in these terms prevents a consumer from bringing proceedings in any court available to them under applicable consumer law.

If you have a complaint, please contact us first so that we have an opportunity to resolve the matter.

18. Changes to these terms

We may update these Terms of Service from time to time.

The terms applying to a purchase are the terms in effect when the relevant contract is formed.

Updates will apply to future purchases and will be published on the website.
